Mark Flaherty and Grace Brunton-Makeham from the Legal team at the University of Melbourne invite SOUL members to join a discussion about the University of Melbourne’s experience and share some key learnings.

Outline:
Recently the Fair Work Ombudsman has had a particular focus on the University sector, with at least 12 University being actively investigated. This additional scrutiny has prompted Universities to review their payroll compliance, with many Universities now engaged in multi-year wage remediation programs. Universities are also now dealing with the aftermath including prosecutions, penalties, Enforceable Undertakings, and changes to University governance.
The University of Melbourne’s journey has involved: disputes and agitation with the NTEU, a 2 ½ year FWO investigation, a large and complex wage remediation program ($72M back paid and counting), 2 x FWO prosecutions, and most recently entering into a new type of Enforceable Undertaking with the FWO.
The session will focus on:
The FWO’s investigative and enforcement approach
Key learnings from UoM’s wage remediation program
Negotiating enforcement action with the FWO, including novel terms secured by UoM in its EU
Managing the risks of an EU once signed
